These Terms are applicable to Contracts between Pirwa Hostels & B&Bs (occasionally referred to throughout at "Pirwa") and its clients and apply to all reservations, bookings and agreements for accommodation and other services at Pirwa.
Clients are invited to read these provisions and note their responsibilities, arrangements for payments, cancellation terms and limitations on the liability of Pirwa.
Confirmation of a provisional reservation is dependent on availability, receipt of accurate information from the client, and payment of a deposit and service charge. This deposit and service charge shall be considered non-refundable.
The services that are the subject of the provisional reservation can be released and be resold without any further notification to the Client in the event that the Client does not provide a deposit payment.
Any amendments to your reservation must be notified to and agreed with Pirwa directly. In order to cancel or amend your reservation, you must notify Pirwa two days (48 hrs) prior to your original reserved arrival date in a written notice which includes the Reservation Reference number. In making a reservation, it shall be your responsibility to disclose to Pirwa any physical or mental condition to which you or a member of your party is subject to and of which Pirwa should be notified and which may require special facilities.
SUPPLY OF THE SERVICES
Pirwa shall provide the Services to the Client subject to the Reservation Agreement. The Client shall at its own expense supply Pirwa with all necessary data or other information relating to the Services within sufficient time to enable Pirwa to provide the Services in accordance with the Reservation Agreement. The Client shall ensure the accuracy of all such information. Pirwa may at any time without notifying the Client make any changes to the Services which are necessary to comply with any applicable safety or other statutory requirements, or which do not materially affect the nature or quality of the Services. Pirwa does not condone any form of bullying or harassment in the workplace. If the harasser is a guest of or a visitor to the hotel, the employee should instead convey promptly and clearly their feelings of discomfort to a manager and explain if it is interfering with their work. The manager will then deal with the matter in the most appropriate manner. The employee is strongly discouraged from raising this personally with the guest.
The charges payable by the Client shall be detailed in writing by Pirwa. If charge amounts are unspecified or additional and varied Services are provided to the Client, the Client shall pay the Standard Charges at the prevailing rate on the day the Services are provided and any additional sums which are agreed between Pirwa and the Client for the provision of the Services.
Pirwa may vary the Standard Charges from time to time. ("Standard Charges" means the charges shown in any brochure of Pirwa or other published literature relating to the Services in force from time to time).
If any services under the contract are varied prior to arrival then the payment made will reflect the latest details contained in the written details of Pirwa. Remainder of balance (total cost minus prepaid deposit) must be paid at the time of arrival (check-in). Any additional charges due to Pirwa from the Client for Services (including but not limited to tour services, transport services, food and drink) shall be paid by the Client on presentation of an invoice.
All outstanding charges must be settled prior the client leaving the hostel.
CANCELLATION CHARGES ("NO SHOWS")
The Client agrees to forfeit the deposit and applicable service charges to Pirwa in the event of cancellation of the Services or if the Client and/or their guests fail to take up the Services at the time and on the day specified in the reservation agreement. Pirwa will confirm cancellations in writing.
VARIATION IN SERVICES REQUIRED
Any variation of numbers, accommodation and other travel requirements specified for the Services or other changes or additions must be agreed by the Client and Pirwa in writing. Availability and prices are not guaranteed in the event of requested changes to the reservation. Services charge may apply in order to affect reservation changes, depending on difference of price in accommodation requested, seasonal variability, or other factors.
In order to ensure that all arrangements are properly made, pick-up services must be requested in writing at least 24 hours before the service is needed. If the client has requested pick-up services in advance or at the time of reservation and provided travel details such as airline and flight information or bus information, the client is required to notify Pirwa in the event of changes to arrival time or place. Pirwa is not responsible for failure to complete a pick-up service in the case of last-minute or unforeseen travel changes.
Please be aware that Pick-up Services are only provided from the hours of 6:50am through 3:50pm (Cusco Time).
LIABILITY OF PIRWA
Pirwa shall have no liability to the Client for any loss, damage, costs, expenses or other claims for compensation arising from any instructions supplied by the Client which are incomplete, incorrect, inaccurate, illegible, out of sequence or in the wrong form, or arising from their late arrival or non-arrival, or any other fault of the Client.
Except in respect of death or personal injury directly caused by the Pirwa's negligence, or as expressly provided in these Terms, Pirwa shall not be liable to the Client by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the Contract, for any loss of profit or any indirect, special or consequential loss, damage, costs, expenses or other claims (whether caused by the negligence of Pirwa, its servants or agents or otherwise) which arise out of or in connection with the provision of the Services (including any delay in providing or failure to provide the Services) or their use by the Client, and the entire liability of Pirwa in connection with the Contract shall not exceed the amount of the Pirwa's charges for the provision of the Services, except as expressly provided in these Terms.
Pirwa may (without limiting any other remedy) at any time terminate the Contract by giving written notice to the Client if the Client commits any breach of these Terms.
You should note that Pirwa does not warrant that the information published on this website will be error free and in using this website you acknowledge that the accommodation details and all other information including information relating to travel services published on this website may include inaccuracies, mistranslations or typographical errors.
AS A CONDITION OF YOUR USE OF THIS WEBSITE
You undertake to Pirwa that you will not use this website for any purpose that is unlawful or prohibited by these Terms.
AGE AND RESPONSIBILITY
You confirm that you are of sufficient legal age to use this website and to create binding legal obligations for any liability you may incur as a result of the use of this website. You understand that you are financially responsible for all uses of this website by you and those using your log-in information.
ALL USE BY YOU OF THIS WEBSITE IS AT YOUR OWN RISK. YOU ASSUME COMPLETE RESPONSIBILITY FOR AND FOR ALL RISK OR LOSS RESULTING FROM YOUR DOWNLOADING AND/OR USE OF MATERIALS PROVIDED ON THIS WEBSITE. These Terms and your use of this website are governed by the laws of Peru. You hereby consent to the exclusive jurisdiction of Peruvian courts in all disputes arising out of or relating to the use of this website each time you access the website. If any part of these Terms is determined to be invalid or unenforceable, including but not limited to the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these Terms shall continue in effect.

Your details will be used by Pirwa to provide the services requested, to operate the reservation website and, occasionally, to inform you of new features, services and products from Pirwa (subject to the preferences you have expressed to us). On occasions, we may supply statistics about our customers to third parties such as hostels or other agents. These statistics never contain personally identifying information.
